Evan E. D’Amico
Mr. D’Amico litigates and argues complex commercial litigation actions and real estate litigation matters. He has experience handling all aspects of litigation from the initial pleadings phase through discovery, motion practice, trial, and appeal.
Mr. D’Amico has litigated contested mortgage foreclosures, condominium lien foreclosures, cooperative foreclosures, commercial and residential landlord tenant proceedings, wrongful foreclosures, title disputes, origination, predatory lending, improper mortgage securitization, civil provisions of the Racketeer Influenced and Corrupt Organization Act (RICO), lender liability, consumer fraud, and violations of federal and state consumer protection statutes and regulations including the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), the Home Owners Equity Protection Act (HOEPA), the Telephone Consumer Protection Act (TCPA), the Fair Debt Collection Practices Act (FDCPA), and the Fair Credit Reporting Act (FCRA).
Mr. D’Amico has successfully represented clients in many cases including securities litigation, breach of contract, FINRA and AAA disputes, alternative dispute resolution, administrative proceedings, construction actions, non-competition and non-solicitation agreements, bankruptcy disputes, and accounting proceedings regarding trusts. Focusing on the intersection of regulation and litigation, Mr. D’Amico has advised his clients on regulatory and compliance counseling matters, including complaints involving the Consumer Financial Protection Bureau (CFPB) and the New York State Attorney General’s Office.
Mr. D’Amico received his B.A. in Political Science from Binghamton University and his J.D., cum laude, from Touro Law Center, where he was a member the Touro Law Review, a Touro Law Honors Scholar, on the Dean’s List, and a Teacher’s Assistant. In law school, Mr. D’Amico clerked for the Hon. Denis R. Hurley, U.S. District Court, Eastern District of New York and also interned for the United States Attorney’s Office for the Eastern District of New York. Mr. D’Amico also won the Award for Academic Excellence as the best Oral Advocate in his class.
