Important Update on Family Homelessness & Eviction Prevention Supplement (FHEPS)

The New York State Office of Temporary and Disability Assistance (“OTDA”) has granted a temporary modification to the FHEPS rental assistance program in light of the COVID-19 Eviction and Foreclosure Prevention Act.  Prior to this waiver families with children under 18 could only qualify for FHEPS rental payments if the owner commenced an eviction proceeding against the renter. OTDA has agreed to waive the lawsuit requirement until May 1, 2021 or the end of the eviction moratorium.

If you have renters who are eligible for FHEPS rental assistance they can obtain funds without a pending housing court proceeding by producing

  1. A written rental demand that complies with RPAPL §711(2), and
  2. A copy of the Tenant’s Declaration of Hardship During the COVID-19 Pandemic.
