New Partner Joins Borah, Goldstein, Altschuler, Nahins & Goidel, P.C.

The Firm is pleased to announce that Martha Cruz has joined
as a partner working with the Firm’s Loft Law/Loft Development Practice
Martha Cruz has more than 14 years Loft Law experience. In 2005, she became the Director of Hearings for the New York City Loft Board. As Director of Hearings, she managed the Loft Board’s hearings caseload.
In 2009, the Executive Director of the Loft Board promoted her to Deputy General Counsel, a position she held until 2019. As Deputy General Counsel, Ms. Cruz assisted the Executive Director in the Loft Board’s restructuring, policy making and the drafting of the Loft Board’s regulations. She also counseled the Loft Board on policy matters, rule making and proposed legislation.
Ms. Cruz supervised the legal staff and advised the Loft Board on Loft Law case law and precedent. As Deputy General Counsel, she worked with Corporation Counsel on litigation brought against the Loft Board.
Ms. Cruz has conducted training about the Loft Law. She has also testified before the City Council and the Board of Standards and Appeals on issues related to the Loft Law.

MEMO/Forum New York City Climate Mobilization Act: How NYC Multifamily Owners can Save Green Going Green,  Eric M. Goidel and Bradon M. James., (October 31, 2019)

Eric and Brandon will lead a workshop related to New York City Climate Mobilization Act at NYC Multifamily Summit.

The recently enacted Local Law 97 of 2019 establishes emissions limits with possible heavy fines for building owners who do not comply with the new standards. However, the emissions laws also provide an avenue to greatly improve net operating income through changes in building systems. Join this special workshop to learn how the new law will be applied and how emissions will be calculated, along with understanding compliance requirements, alternative compliance methods, exemptions, and penalties. There will be a discussion concerning the New York City Sustainable Energy Loan Program designed to facilitate energy efficiency improvements and renewable energy systems. Recommended for all multifamily owners with New York City buildings larger than 25,000 square feet.

The section of the proprietary lease dealing with termination of the proprietary lease is one of the most important sections. It gives a board of directors the ability to evict and foreclose upon a shareholder who is not complying with the proprietary lease. Many proprietary leases were drafted 40 to 50 years ago. SPEAKING ENGAGEMENT: What You Need to Know About the Tenant Harassment Laws (February 28, 2018), CHIP

Partner David Cabrera, will be serving as panelist during CHIP’s seminar on tenant harrasment laws. David will discuss new laws in NYC that necessitate changes to “tenant harassment” provisions, including stiffer penalties, the award of damages, apartment conditions, business practices, and more intense government oversight.
