The Emergency Rental Assistance Program (ERAP) has begun distributing its funds. Please note that you must apply the funds you receive to the specific months designated by the ERAP approval email and/or the letter received with the ERAP payment. Please save this information and provide it to our office when commencing new nonpayment proceedings.
Additionally, ERAP requires a landlord to provide its tenants with a notice of their rights as a result of your acceptance of ERAP funds. Our office will assist you in drafting the appropriate notice in order to comply with the law as well as help you address and navigate issues that may arise when accepting funds including, but not limited to: what to do when ERAP does not cover the entire balance owed and/or situations where only some of the months applied for are approved by ERAP.
As such, if you do not have any written information regarding how to apply an ERAP payment, it is important to seek this information. You may call ERAP customer service at (844) 691-7368 and request this information.
Failure to properly apply the ERAP payment may cause negative consequences, including but not limited to dismissal of nonpayment proceedings and/or waiver of the rent at issue.
